These Terms of Service (“Terms”) govern your access to and use of the Nuclevo software, browser extension, website at nuclevo.com, and all related automation tools (collectively, the “Service”). By using the Service, you agree to these Terms.
If you are entering into these Terms on behalf of an entity, you represent that you have the legal authority to bind that entity.
1. Access and Use
1.1 Provision of Access. Nuclevo provides a workflow automation platform via a browser extension. The Service allows you to create, manage, and execute custom workflows on third-party websites. Subject to your compliance with these Terms, Nuclevo grants you a limited, non-transferable right to access and use the Service.
1.2 Local Processing. You acknowledge and agree that Nuclevo is designed as a local-first automation tool. While your workflow configurations are stored in our database for synchronization, the execution of these workflows occurs locally within your browser. Nuclevo does not remotely track your browsing history or the specific data contained within web pages you visit.
1.3 Use Restrictions. You shall not use the Service to: (i) interfere with, bypass, or disable security measures or "bot" detection of any third-party website; (ii) automate interactions with banking, government, or healthcare portals where such automation is prohibited; (iii) engage in large-scale data scraping for commercial resale; (iv) distribute spam, malware, or engage in fraudulent activities; or (v) violate the privacy rights or terms of service of any third-party platform. Any violation of these restrictions may result in immediate account termination without a refund.
2. Eligibility
You must be at least 18 years of age to use the Service. By agreeing to these Terms, you represent and warrant that you are at least 18 years old and that your use of the Service complies with all applicable laws.
3. Account Registration
To use Nuclevo, you may register via a username/password or Google social sign-in. You are responsible for maintaining the confidentiality of your credentials. We use Google Analytics on nuclevo.com to monitor and improve our website performance.
4. Ownership and Licenses
4.1 User Workflows. You retain all right, title, and interest in and to the workflows you create using the Service ("User Workflows"). Nuclevo does not claim ownership over your workflows.
4.2 Ecosystem Restriction. While you own your workflows, they are specifically designed for the Nuclevo ecosystem. The Service does not support the export of workflows for execution in external environments.
4.3 Nuclevo IP. Nuclevo owns the Service, including the extension architecture, UI/UX, and all improvements thereto.
5. Payment and Subscription Terms
5.1 Subscription Plans. We offer various paid subscription plans as described on our pricing page. Payments are processed securely through our merchant of record, Paddle.
5.2 Free Trial. We offer a 14-day free trial. By signing up for a trial, you agree that your account will automatically roll into a paid subscription at the end of the trial period unless you cancel before the 14th day ends.
5.3 Refund Policy & Money-Back Guarantee. In accordance with our payment provider's terms, we offer a 14-day money-back guarantee on initial subscription payments. You may request a full refund within 14 days of the transaction date by contacting support. After this 14-day window, all fees are generally non-refundable except as required by law or in cases of verified technical failure as outlined in our Refund Policy.
6. Termination and Data Deletion
6.1 Termination. You may stop using the Service at any time. We reserve the right to suspend or terminate your access to the Service at our discretion, without notice, for any conduct that we believe violates these Terms or is harmful to other users, us, or third parties. If we terminate your subscription for a violation of these Terms, you will not be entitled to any refund.
6.2 Permanent Deletion. Upon the deletion of your account, all User Workflows associated with your account will be permanently and automatically deleted. We may also terminate and delete accounts that have been inactive for more than one year.
7. Disclaimers & Third-Party Websites
7.1 Third-Party Site Rules. Nuclevo automates interactions with third-party websites. You acknowledge that such websites may have policies prohibiting automation. Nuclevo is not responsible for any loss of access, account suspension, or banning that may occur on third-party websites as a result of your use of the Service.
7.2 "As-Is" Service. THE SERVICE IS PROVIDED "AS IS." NUCLEVO DISCLAIMS ALL WARRANTIES, INCLUDING MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE.
8. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, NUCLEVO’S TOTAL LIABILITY SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO USE THE SERVICE IN THE SIX MONTHS PRIOR TO THE CLAIM, OR (B) $100.
9. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the state or country where Nuclevo is headquartered, without regard to its conflict of law provisions. You agree to submit to the personal and exclusive jurisdiction of the courts located within that territory to resolve any legal matter arising from these Terms.
